Ilir Meta mbi vendimin nr. 36, dat\u00eb 04.11.2021, t\u00eb Gjykat\u00ebs Kushtetuese, p\u00ebr zgjedhjet e 30 qershorit 2019.<\/h2>\n\n\n\n<p>Dit\u00ebn e djeshme, Presidenti \u00ebsht\u00eb njohur zyrtarisht me vendimin nr. 36, dat\u00eb 4.11.2021, t\u00eb Gjykat\u00ebs Kushtetuese, p\u00ebrmes t\u00eb cilit kjo gjykat\u00eb vendosi t\u00eb, \u201cRr\u00ebzoj\u00eb k\u00ebrkes\u00ebn e Shoqat\u00ebs s\u00eb Bashkive t\u00eb Shqip\u00ebris\u00eb\u201d, e cila prej dat\u00ebs 18 korrik 2019, i kishte k\u00ebrkuar k\u00ebsaj gjykate&nbsp;<em>\u201cShpalljen antikushtetues t\u00eb procesit t\u00eb votimeve nj\u00eb partiake t\u00eb 30 qershorit 2019\u201d.<\/em><\/p>\n\n\n\n<p>Si\u00e7 t\u00eb gjith\u00eb jeni n\u00eb dijeni, Presidenti i Republik\u00ebs mori pjes\u00eb n\u00eb k\u00ebt\u00eb gjykim kushtetues n\u00eb cil\u00ebsin\u00eb e subjektit t\u00eb interesuar dhe mb\u00ebshteti k\u00ebrkes\u00ebn e Shoqat\u00ebs s\u00eb Bashkive t\u00eb Shqip\u00ebris\u00eb, duke k\u00ebrkuar pranimin e saj sipas objektit.<\/p>\n\n\n\n<p>Jo vet\u00ebm kaq, por Presidenti i Republik\u00ebs, n\u00eb k\u00ebt\u00eb gjykim, si pal\u00eb e interesuar, i k\u00ebrkoi Gjykat\u00ebs Kushtetuese, e cila \u00ebsht\u00eb instanca e vetme e ngarkuar me zgjidhjen e mosmarr\u00ebveshjeve kushtetuese, kontrollin e kushtetutshm\u00ebris\u00eb s\u00eb akteve apo vendimeve t\u00eb nxjerra nga organet e pushtetit shtet\u00ebror, q\u00eb&nbsp;<strong>t\u00eb p\u00ebrmbush\u00eb rolin<\/strong>,&nbsp;<strong>misionin dhe p\u00ebrgjegj\u00ebsit\u00eb q\u00eb Kushtetuta i ka dh\u00ebn\u00eb<\/strong>, n\u00eb m\u00ebnyr\u00eb t\u00eb pavarur, t\u00eb pandikuar, me kuraj\u00eb e p\u00ebrgjegjshm\u00ebri t\u00eb plot\u00eb, n\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb gjith\u00eb shqiptar\u00ebve t\u2019i ofrohej nj\u00eb vendimmarrje e plot\u00eb mbi themelin e k\u00ebrkimit, duke adresuar dhe orientuar nj\u00ebkoh\u00ebsisht dhe m\u00ebnyr\u00ebn e zgjidhjes s\u00eb pasojave t\u00eb r\u00ebnda q\u00eb kan\u00eb ardhur nga nj\u00eb proces votimesh monist, antikushtetues, i nj\u00ebansh\u00ebm dhe fiktiv, si\u00e7 ishte ai i 30 qershor 2019.<\/p>\n\n\n\n<p>Vet\u00ebm p\u00ebrmes nj\u00eb vendimmarrje t\u00eb themelt\u00eb, Gjykata Kushtetuese, do t\u2019i rikthente popullit shqiptar mund\u00ebsin\u00eb q\u00eb t\u00eb shprehte vullnetin e tij, p\u00ebrmes nj\u00eb procesi zgjedhor t\u00eb lir\u00eb, t\u00eb ndersh\u00ebm, t\u00eb fsheht\u00eb, dhe n\u00eb p\u00ebrmbushje t\u00eb gjith\u00eb standardeve kushtetuese, ligjore e nd\u00ebrkomb\u00ebtare, p\u00ebr t\u00eb zgjedhur p\u00ebrfaq\u00ebsuesit e tij n\u00eb pushtetin vendor.<\/p>\n\n\n\n<p><strong>Por, p\u00ebrkund\u00ebr k\u00ebsaj pritshm\u00ebrie t\u00eb lart\u00eb dhe legjitime<\/strong>, para s\u00eb gjithash t\u00eb popullit shqiptar, por dhe t\u00eb institucioneve nd\u00ebrkomb\u00ebtare, t\u00eb cil\u00ebt e kishin kusht\u00ebzuar ecurin\u00eb e procesit t\u00eb \u00e7eljes s\u00eb negocimit dhe integrimit t\u00eb Shqip\u00ebris\u00eb, me plot\u00ebsimin edhe t\u00eb kushtit, q\u00eb Shqip\u00ebria do duhej t\u00eb kishte nj\u00eb vendim p\u00ebrfundimtar t\u00eb Gjykat\u00ebs Kushtetuese mbi zgjedhjet lokale t\u00eb 30 qershorit 2019,&nbsp;<strong>kjo Gjykat\u00eb,<\/strong>&nbsp;<strong>p\u00ebr fat t\u00eb keq, i zhg\u00ebnjeu t\u00eb gjith\u00eb.<\/strong><\/p>\n\n\n\n<p>Gjykata Kushtetuese, p\u00ebr interesa q\u00eb nuk p\u00ebrkojn\u00eb me ato t\u00eb popullit shqiptar, me k\u00ebt\u00eb vendim hoqi dor\u00eb nga ushtrimi i funksionit t\u00eb saj sublim&nbsp;dhe e shpalli veten jo kompetente, p\u00ebr t\u00eb mbrojtur t\u00eb drejtat dhe lirit\u00eb themelore t\u00eb shqiptar\u00ebve, parimeve dhe vlerave m\u00eb t\u00eb larta tona shoq\u00ebrore e morale mbi t\u00eb cilat ne si shqiptar\u00eb kemi vendosur t\u00eb nd\u00ebrtojm\u00eb jet\u00ebn ton\u00eb, n\u00eb nj\u00eb shoq\u00ebri me demokraci funksionale.<\/p>\n\n\n\n<p>P\u00ebr fat t\u00eb keq, Gjykata Kushtetuese, me vendimmarrjen e saj p\u00ebr t\u00eb deklaruar munges\u00ebn e juridiksionit kushtetues, faktikisht e la \u00e7\u00ebshtjen pa zgjidhje p\u00ebrfundimtare.<\/p>\n\n\n\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/president.al\/wp-content\/uploads\/2021\/12\/keshilltaret-devisha-blushi-konference-shtypi.jpg\" alt=\"\" width=\"1280\" height=\"853\" srcset=\"\">Gjykata Kushtetuese nuk mori guximin t\u00eb shpjegonte dhe t`i kthente p\u00ebrgjigje k\u00ebtyre pyetjeve q\u00eb iu parashtruan n\u00eb \u00e7\u00ebshtjen objekt shqyrtimi:<\/p>\n\n\n\n<p>\u2022 N\u00eb procesin e votimeve nj\u00eb partiake t\u00eb 30 qershorit 2019, a iu mohua 3,536,016 shtetasve shqiptar\u00eb me t\u00eb drejt\u00eb vote, e drejta kushtetuese p\u00ebr t\u00eb zgjedhur, n\u00eb m\u00ebnyr\u00eb t\u00eb fsheht\u00eb, t\u00eb pandikuar dhe nd\u00ebrmjet alternativave konkurruese?<br>\u2022 A mundet, sipas Kushtetut\u00ebs, t\u00eb zhvillohen zgjedhje n\u00eb Republik\u00ebn e Shqip\u00ebris\u00eb pa nj\u00eb dat\u00eb t\u00eb caktuar nga Presidenti i Republik\u00ebs, sipas nenit 92\/gj t\u00eb Kushtetut\u00ebs?<br>\u2022 A ishin votimet p\u00ebr pushtetin vendor t\u00eb zhvilluara n\u00eb 30 qershor 2019 dhe rezultatet e tij, n\u00eb p\u00ebrputhje me parimet, vlerat, t\u00eb drejtat dhe lirit\u00eb themelore kushtetuese?<br>\u2022 A mundet q\u00eb, sipas Kushtetut\u00ebs, data e zgjedhjeve t\u00eb diktohet nga Kuvendi p\u00ebrmes nj\u00eb rezolute?<br>\u2022 A konsiderohen zgjedhjet pluraliste kur n\u00eb gar\u00eb paraqitet vet\u00ebm nj\u00eb kandidat?<br>\u2022 A parashikon Kodi Zgjedhor zgjidhjen e situat\u00ebs kur n\u00eb zgjedhje merr pjes\u00eb vet\u00ebm nj\u00eb kandidat? N\u00ebse ka boshll\u00ebk ligjor, a duhet detyrimisht t\u00eb plot\u00ebsohet ky boshll\u00ebk, p\u00ebr t\u00eb mos cenuar t\u00eb drejt\u00ebn kushtetuese t\u00eb shtetasve p\u00ebr t\u00eb zgjedhur midis alternativave?<br>\u2022 N\u00eb nj\u00eb shtet ku prezumohet se funksionon shteti i s\u00eb drejt\u00ebs, a mundet q\u00eb nj\u00eb organ fundor i administrat\u00ebs zgjedhore t\u00eb refuzoj\u00eb zbatimin e Dekreteve t\u00eb Kreut t\u00eb Shtetit p\u00ebr caktimin e dat\u00ebs s\u00eb zgjedhjeve?<br>\u2022 N\u00eb nj\u00eb shtet ku prezumohet se funksionon parimi i shtetit t\u00eb s\u00eb drejt\u00ebs, ndarjes dhe balancimit t\u00eb pushteteve, a mundet Qeveria t\u00eb bllokoj\u00eb botimin n\u00eb Fletoren Zyrtare t\u00eb dekretit t\u00eb Presidentit t\u00eb Republik\u00ebs p\u00ebr caktimin e dat\u00ebs s\u00eb zgjedhjeve?<br>\u2022 A ishin antikushtetuese dhe n\u00eb kund\u00ebrshtim me parimin e shtetit t\u00eb s\u00eb drejt\u00ebs, veprimet dhe vendimmarrjet e Kuvendit, Qeveris\u00eb dhe t\u00eb administrat\u00ebs zgjedhore?<\/p>\n\n\n\n<p><strong>K\u00ebto \u00e7\u00ebshtje kaq thelb\u00ebsore, Gjykata Kushtetuese i la pa p\u00ebrgjigje!<\/strong><\/p>\n\n\n\n<p>N\u00ebse Gjykata Kushtetuese, do t\u00eb kishte trajtuar pa anashkaluar secil\u00ebn prej k\u00ebtyre pyetjeve, sot do t\u00eb kishim nj\u00eb vendim themeli.<\/p>\n\n\n\n<p>\u00cbsht\u00eb e qart\u00eb q\u00eb, me vendimmarrjen e saj, Gjykata Kushtetuese, nuk pati vullnet ta zgjidhte k\u00ebt\u00eb \u00e7\u00ebshtje p\u00ebrmes juridiksionit gjyq\u00ebsor kushtetues,&nbsp;<strong>por ia la s\u00ebrish \u00e7\u00ebshtjen, juridiksionit \u201cpolitik\u201d.<\/strong><\/p>\n\n\n\n<p>P\u00ebr t\u2019iu shmangur themelit t\u00eb \u00e7\u00ebshtjes dhe p\u00ebr ta b\u00ebr\u00eb veten jo-kompetente, Gjykata Kushtetuese, gjat\u00eb veprimtaris\u00eb s\u00eb saj, ka cenuar r\u00ebnd\u00eb parimet e transparenc\u00ebs dhe t\u00eb procesit t\u00eb rregullt ligjor.<\/p>\n\n\n\n<p>N\u00eb seanc\u00ebn e dat\u00ebs 23 qershor 2021, Gjykata Kushtetuese, pasi d\u00ebgjoi parashtrimet dhe prap\u00ebsimet e pal\u00ebve pjes\u00ebmarr\u00ebse n\u00eb gjykim, dhe ku pritej t\u00eb shprehej me vendim,&nbsp;<em>n\u00eb m\u00ebnyr\u00eb t\u00eb papritur e t\u00eb panevojshme<\/em>, vendosi t\u00eb pezulloj\u00eb shqyrtimin e \u00e7\u00ebshtjes dhe t`i drejtohet Komisionit t\u00eb Venecias, p\u00ebr&nbsp;<strong>t\u00eb marr\u00eb nj\u00eb opinion k\u00ebshillimor (amicus curiae), duke u njohur pal\u00ebve n\u00eb proces t\u00eb drejt\u00ebn p\u00ebr t\u00eb propozuar pyetje.<\/strong><\/p>\n\n\n\n<p>Presidenti i Republik\u00ebs, i b\u00ebri me dije Gjykat\u00ebs se,&nbsp;<strong>nuk kishte paqart\u00ebsi dhe rrjedhimisht as ndonj\u00eb pyetje p\u00ebr t\u2019i adresuar Komisionit t\u00eb Venecias, lidhur me \u00e7\u00ebshtjen e procesit t\u00eb votimeve t\u00eb 30 qershorit 2019, antikushtetutshm\u00ebria e t\u00eb cilit ishte objekt shqyrtimi nga ana e gjykat\u00ebs.<\/strong><\/p>\n\n\n\n<p>E vetmja pal\u00eb pjes\u00ebmarr\u00ebse n\u00eb proces, q\u00eb i parashtroi Gjykat\u00ebs Kushtetuese pyetje p\u00ebr Komisionin e Venecias, ishte pala k\u00ebrkuese, Shoqata e Bashkive, e cila, k\u00ebrkoi q\u00eb Gjykata Kushtetuese t`i p\u00ebrcillte Komisionit t\u00eb Venecias pyetjen e saj me k\u00ebt\u00eb p\u00ebrmbajtje:<\/p>\n\n\n\n<p>\u2022&nbsp;<em>A \u00ebsht\u00eb Dekreti i Presidentit p\u00ebr caktimin e dat\u00ebs s\u00eb zgjedhjeve dhe ai p\u00ebr anulimin e saj, nj\u00eb akt me karakter t\u00eb p\u00ebrgjithsh\u00ebm ose akt normativ kushtetues apo \u00ebsht\u00eb nj\u00eb akt administrativ n\u00ebnligjor individual dhe n\u00eb \u00e7do rast, a mund t\u00eb refuzohej zbatimi i tyre nga Komisioni Qendror i Zgjedhjeve sikurse ka ndodhur, apo duhej q\u00eb k\u00ebto dekrete t\u2019ju n\u00ebnshtroheshin vler\u00ebsimit mbi kushtetutshm\u00ebrin\u00eb vet\u00ebm nga Gjykata Kushtetuese mbi baz\u00ebn e k\u00ebrkimeve t\u00eb subjekteve q\u00eb kishin pretendime n\u00eb p\u00ebrputhje me kriteret kushtetuese p\u00ebr v\u00ebnien n\u00eb l\u00ebvizje t\u00eb k\u00ebsaj gjykate?<\/em><\/p>\n\n\n\n<p><strong>Pyetja q\u00eb ngriti shoqata e Bashkive, ishte n\u00eb vetvete themeli i \u00e7\u00ebshtjes.<\/strong><\/p>\n\n\n\n<p>Gjykata Kushtetuese, n\u00eb dat\u00ebn 09.07.2021, i d\u00ebrgoi Komisionit t\u00eb Venecias k\u00ebrkes\u00ebn p\u00ebr dh\u00ebnien e nj\u00eb opinioni,<strong>&nbsp;duke injoruar dhe fshehur&nbsp;<\/strong>pyetjen q\u00eb kishte k\u00ebrkuar Shoqata e Bashkive t\u00eb Shqip\u00ebris\u00eb, dhe duke orientuar Komisionin e Venecias t\u00eb shprehej vet\u00ebm p\u00ebr 3 pyetjet e hartuara nga vet Gjykata.<\/p>\n\n\n\n<p>K\u00ebto pyetje t\u00eb hartuara nga Gjykata, jo vet\u00ebm q\u00eb nuk kishin lidhje t\u00eb drejtp\u00ebrdrejt\u00eb me objektin e gjykimit, por n\u00eb m\u00ebnyr\u00ebn se si ato u formuluan, qartazi k\u00ebrkonin t\u00eb orientonin dh\u00ebnien e nj\u00eb Opinioni q\u00eb do t\u00eb sh\u00ebrbente p\u00ebr t\u00eb legjitimuar vendimmarrjen e saj t\u00eb m\u00ebvonshme, p\u00ebr shpalljen e Gjykat\u00ebs Kushtetuese si jo kompetente p\u00ebr shqyrtimin e \u00e7\u00ebshtjes.<\/p>\n\n\n\n<p>Kjo \u00ebsht\u00eb nj\u00eb nga shkeljet m\u00eb t\u00eb r\u00ebnda t\u00eb Gjykat\u00ebs Kushtetuese, q\u00eb p\u00ebrmes nj\u00eb procesi jo transparent, duke cenuar procesin e rregullt ligjor, dhe barazin\u00eb e pal\u00ebve n\u00eb gjykim, i mohoi Shoqat\u00ebs s\u00eb Bashkive t\u00eb Shqip\u00ebris\u00eb, t\u00eb drejt\u00ebn p\u00ebr t\u00eb marr\u00eb nj\u00eb p\u00ebrgjigje p\u00ebrfundimtare p\u00ebr pyetjen q\u00eb kishte ngritur.<\/p>\n\n\n\n<p>Madje, Gjykata Kushtetuese as nuk e njoftoi k\u00ebt\u00eb t\u00eb fundit (Shoqat\u00ebn e Bashkive t\u00eb Shqip\u00ebris\u00eb) dhe as i dha asaj ndonj\u00eb shpjegim p\u00ebr k\u00ebt\u00eb fakt.<\/p>\n\n\n\n<p>Kjo m\u00ebnyr\u00eb operimi e Gjykat\u00ebs Kushtetuese, na krijon bindjen e pal\u00ebkundur se, Gjykata Kushtetuese, e kishte marr\u00eb vendimin e saj p\u00ebr ta shpallur veten&nbsp;<strong>jo kompetente p\u00ebr zgjidhjen e \u00e7\u00ebshtjes, q\u00eb prej dat\u00ebs 23 qershor 2021<\/strong>, dhe d\u00ebrgimi i \u00e7\u00ebshtjes n\u00eb m\u00ebnyr\u00eb t\u00eb papritur n\u00eb Komisionin e Venecias, p\u00ebr t\u00eb marr\u00eb nj\u00eb opinion k\u00ebshillimor, ishte nj\u00eb&nbsp;<strong>taktik\u00eb e gjykat\u00ebs<\/strong>, q\u00eb p\u00ebrmes procedurave, t\u00eb shtynte n\u00eb koh\u00eb vendimmarrjen e saj, me q\u00ebllim q\u00eb t`i krijonte vetes nj\u00eb justifikim p\u00ebrball\u00eb publikut, p\u00ebr mos p\u00ebrmbushjen e detyr\u00ebs dhe funksionit themelor t\u00eb saj, duke u vet\u00ebshpallur jo kompetente p\u00ebr shqyrtimin e themelit t\u00eb \u00e7\u00ebshtjes.<\/p>\n\n\n\n<p>Se sa kjo m\u00ebnyr\u00eb veprimi e Gjykat\u00ebs Kushtetuese iu p\u00ebrshtat k\u00ebrkesave t\u00eb Qeveris\u00eb, kjo nuk ka nevoj\u00eb p\u00ebr komente.<\/p>\n\n\n\n<p>Mjafton t\u00eb lexoni vendimin dhe e kuptoni se Gjykata Kushtetuese dhe Qeveria jan\u00eb n\u00eb t\u00eb nj\u00ebjt\u00ebn linj\u00eb arsyetimi.<\/p>\n\n\n\n<p>Se sa Qeveria, p\u00ebrmes p\u00ebrfaq\u00ebsuesve t\u00eb saj n\u00eb Komisionin e Venecias, ka mundur t\u00eb ndikoj\u00eb n\u00eb orientimin e p\u00ebrgjigjes p\u00ebr Gjykat\u00ebn Kushtetuese, kjo vet\u00ebkuptohet, pasi qeveria \u00ebsht\u00eb&nbsp;<em>de facto<\/em>&nbsp;e p\u00ebrfaq\u00ebsuar dhe lidhja midis k\u00ebtyre dy organeve, ku si n\u00eb Gjykat\u00eb, dhe n\u00eb Komisionin e Venecias, p\u00ebrfaq\u00ebsohet nga t\u00eb em\u00ebruarit e saj.<\/p>\n\n\n\n<p>Opinioni i Komisionit t\u00eb Venecias ishte i paraprogramuar, p\u00ebr shkak t\u00eb natyr\u00ebs shum\u00eb t\u00eb kufizuar t\u00eb pyetjeve t\u00eb ngritura nga Gjykata Kushtetuese, q\u00eb i dhan\u00eb nj\u00eb mandat po aq t\u00eb kufizuar interpretativ Komisionit t\u00eb Venecias.<\/p>\n\n\n\n<p>E megjithat\u00eb, formalisht, Komisioni i Venecias i kujtoi edhe nj\u00eb her\u00eb Gjykat\u00ebs Kushtetuese se, nuk mund t\u00eb z\u00ebvend\u00ebsoj\u00eb institucionet e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, dhe se vet\u00ebm Gjykata Kushtetuese ka tagrin t\u00eb vendos\u00eb mbi interpretimin final t\u00eb Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb, duke i rikujtuar p\u00ebrgjegj\u00ebsin\u00eb q\u00eb kjo gjykat\u00eb ka p\u00ebr t`u shprehur p\u00ebr \u00e7\u00ebshtje t\u00eb k\u00ebsaj r\u00ebnd\u00ebsie.<\/p>\n\n\n\n<p>Kjo \u00ebsht\u00eb gjendja m\u00eb e r\u00ebnd\u00eb e keqfunksionimit t\u00eb sistemit t\u00eb drejt\u00ebsis\u00eb, ku institucionet m\u00eb larta pjes\u00eb e tij, deklarohen t\u00eb ngritura dhe funksionale vet\u00ebm p\u00ebr numra dhe si godina.<\/p>\n\n\n\n<p>Gjykata Kushtetuese, si instanca e fundit e ngarkuar me kontrollin e kushtetutshm\u00ebris\u00eb s\u00eb akteve apo vendimeve t\u00eb nxjerra nga organet e pushtetit shtet\u00ebror, nuk p\u00ebrmbushi rolin, misionin dhe p\u00ebrgjegj\u00ebsit\u00eb q\u00eb Kushtetuta i ka dh\u00ebn\u00eb.<\/p>\n\n\n\n<p>Nga leximi t\u00ebr\u00ebsor i vendimit t\u00eb Gjykat\u00ebs, kjo vendimmarrje&nbsp;<strong>nuk prek, nuk krijon asnj\u00eb detyrim, dhe nuk nxjerr asnj\u00eb p\u00ebrgjegj\u00ebsi,&nbsp;<\/strong>p\u00ebr asnj\u00eb nga pal\u00ebt e p\u00ebrfshira n\u00eb k\u00ebt\u00eb proces!<\/p>\n\n\n\n<p>Askush nuk \u00ebsht\u00eb i detyruar t\u00eb nd\u00ebrmarr\u00eb ndonj\u00eb veprim p\u00ebr zbatimin e k\u00ebtij vendimi, p\u00ebrsa kompetenc\u00ebs s\u00eb vet Gjykat\u00ebs Kushtetuese p\u00ebr shqyrtimin e kushtetutshm\u00ebris\u00eb s\u00eb nj\u00eb procesi zgjedhor, edhe pse n\u00eb k\u00ebto procese vihen n\u00eb diskutim dhe ushtrohen t\u00eb drejtat dhe lirit\u00eb m\u00eb themelor\u00eb t\u00eb qytetar\u00ebve n\u00eb nj\u00eb rend shoq\u00ebror demokratik dhe pluralist.<\/p>\n\n\n\n<p>N\u00eb nj\u00eb shtet pluralist dhe demokratik, funksioni themelor i drejt\u00ebsis\u00eb kushtetuese \u00ebsht\u00eb, q\u00eb nga nj\u00ebra an\u00eb, t\u00eb garantoj\u00eb kushtetutshm\u00ebrin\u00eb, rendin kushtetues, duke ruajtur t\u00eb pacenuar:<\/p>\n\n\n\n<p>\u2022 shtetin e s\u00eb drejt\u00ebs,<br>\u2022 parimet dhe t\u00eb drejtat themelore t\u00eb sanksionuara n\u00eb Kushtetut\u00eb,<br>\u2022 dh\u00ebnien e zgjidhjes p\u00ebrfundimtare q\u00eb respekton frym\u00ebn e kushtetut\u00ebs dhe vullnetin e sovranit.<\/p>\n\n\n\n<p>Dhe nga ana tjet\u00ebr, drejt\u00ebsia kushtetuese duhet t\u00eb garantoj\u00eb korrektimin e sjelljes s\u00eb organeve kushtetuese, dhe t\u00eb b\u00ebj\u00eb t\u00eb qart\u00eb kufijt\u00eb brenda t\u00eb cil\u00ebve duhet t\u00eb shtrihen kompetencat e secilit pushtet, n\u00eb m\u00ebnyr\u00eb q\u00eb kriza t\u00eb tilla politike dhe t\u00eb p\u00ebrfaq\u00ebsimit apo konflikte t\u00eb ngjashme t\u00eb mos p\u00ebrs\u00ebriten, duke udh\u00ebzuar nj\u00ebkoh\u00ebsisht plot\u00ebsimin e boshll\u00ebqeve ligjore<strong>[1]<\/strong>&nbsp;q\u00eb b\u00ebjn\u00eb t\u00eb mundur zbatimin n\u00eb praktik\u00eb t\u00eb atyre vlerave t\u00eb larta q\u00eb parashikon Kushtetuta e Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb.<\/p>\n\n\n\n<p>Gjykata Kushtetuese, p\u00ebr nj\u00eb \u00e7\u00ebshtje kaq t\u00eb r\u00ebnd\u00ebsishme t\u00eb karakterit kushtetues, nuk e p\u00ebrmbushi misionin e saj sublim, por me vendimin e marr\u00eb nuk dha asnj\u00eb zgjidhje si\u00e7 do duhej t\u00eb b\u00ebnte, dhe si\u00e7 interesat m\u00eb t\u00eb larta t\u00eb vendit e k\u00ebrkonin.<\/p>\n\n\n\n<p>Gjykata Kushtetuese, q\u00ebllimisht vendosi t\u00eb q\u00ebndroj\u00eb m\u00ebnjan\u00eb, duke stisur nj\u00eb shkak, si munges\u00ebn e juridiksionit, nd\u00ebrkoh\u00eb q\u00eb, OSBE\/ODHIR, Bundestagu gjerman, Parlamenti Evropian, dhe K\u00ebshilli i Ministrave t\u00eb BE-s\u00eb<strong>[2]<\/strong>, jan\u00eb shprehur qart\u00eb se i takon Gjykat\u00ebs Kushtetuese q\u00eb t\u00eb merrte vendim p\u00ebrfundimtar lidhur me legjitimitetin e zgjedhjeve t\u00eb 30 qershorit 2019.<\/p>\n\n\n\n<p>Gjykata, nuk e p\u00ebrmbushi misionin e saj, e la \u00e7\u00ebshtjen t\u00eb pazgjidhur, sepse zgjedhjet vendore t\u00eb 30 qershorit 2019, u mbajt\u00ebn nga Qeveria, Kuvendi dhe Komisioni Qendror i Zgjedhjeve, pa Dekret t\u00eb Presidentit, n\u00eb nj\u00eb dat\u00eb q\u00eb nuk ishte p\u00ebrcaktuar si dat\u00eb zgjedhjesh sipas Kushtetut\u00ebs, nd\u00ebrkoh\u00eb q\u00eb dekretet e Presidentit, si ai p\u00ebr anulimin e dat\u00ebs 30 qershor 2019, dhe ai p\u00ebr caktimin e dat\u00ebs 13 tetor 2019 si dat\u00eb p\u00ebr zhvillimin e zgjedhjeve p\u00ebr pushtetin vendor, jan\u00eb n\u00eb fuqi, t\u00eb pacenuara dhe ishin t\u00eb detyrueshme p\u00ebr zbatim.<\/p>\n\n\n\n<p>Gjykata Kushtetuese, me vendimmarrjen p\u00ebr ta shpallur veten si jo kompetente p\u00ebr shqyrtimin e nj\u00eb \u00e7\u00ebshtjeje t\u00eb till\u00eb madhore, krijoi nj\u00eb precedent shum\u00eb t\u00eb rreziksh\u00ebm p\u00ebr shtetin e s\u00eb drejt\u00ebs dhe demokracin\u00eb n\u00eb vendin ton\u00eb.<\/p>\n\n\n\n<p>Sipas k\u00ebtij vendimi, forca qeveris\u00ebse n\u00eb pushtet, kushdo qoft\u00eb ajo, n\u00eb t\u00eb ardhmen, ka mund\u00ebsin\u00eb q\u00eb n\u00eb m\u00ebnyr\u00eb arbitrare dhe antikushtetuese, t\u00eb interpretoj\u00eb e m\u00eb pas t\u00eb realizoj\u00eb zgjedhjet n\u00eb Shqip\u00ebri, n\u00eb dat\u00ebn apo momentin kur ajo d\u00ebshiron, apo edhe t\u00eb mund t\u00eb vendos\u00eb t\u00eb mos kemi fare zgjedhje.<\/p>\n\n\n\n<p>Gjykata Kushtetuese aktuale, nga garante e lirive dhe t\u00eb drejtave themelore politike e zgjedhore t\u00eb qytetar\u00ebve, p\u00ebrkundrazi i hapi dyert antikushtetutshm\u00ebris\u00eb, abuzimit me Kushtetut\u00ebn dhe ligjin, dhe imponimit t\u00eb dhunsh\u00ebm t\u00eb pushtetit t\u00eb radh\u00ebs.<\/p>\n\n\n\n<p>Presidenti i
