Pavar\u00ebsisht p\u00ebrpjekjeve t\u00eb vazhdueshme t\u00eb qeverive rajonale p\u00ebr t\u00eb treguar p\u00ebrparim, nismat reformuese shpesh hasin v\u00ebshtir\u00ebsi p\u00ebr t\u2019u shnd\u00ebrruar n\u00eb ndryshime institucionale dometh\u00ebn\u00ebse. Ky tension \u00ebsht\u00eb ve\u00e7an\u00ebrisht i duksh\u00ebm n\u00eb fushat e shtetit t\u00eb s\u00eb drejt\u00ebs dhe luft\u00ebs kund\u00ebr korrupsionit, ku p\u00ebrputhshm\u00ebria formale dhe performanca e jashtme kan\u00eb marr\u00eb gjithnj\u00eb e m\u00eb shum\u00eb p\u00ebrpar\u00ebsi ndaj substanc\u00ebs demokratike.<\/p>\n\n\n\n<p>Gjat\u00eb dekadave t\u00eb fundit, Shtetet e Bashkuara kan\u00eb luajtur nj\u00eb rol qendror n\u00eb form\u00ebsimin e zhvillimeve politike dhe institucionale n\u00eb Ballkan. Ky angazhim ka prodhuar rezultate t\u00eb p\u00ebrziera dhe shpesh ka qen\u00eb i harmonizuar me agjend\u00ebn e zgjerimit t\u00eb Bashkimit Evropian, ve\u00e7an\u00ebrisht n\u00eb vende si Mali i Zi, Serbia dhe Shqip\u00ebria. Megjithat\u00eb, ndon\u00ebse marr\u00ebdh\u00ebniet diplomatike mbeten t\u00eb forta, rezultatet e reformave kan\u00eb qen\u00eb shum\u00eb m\u00eb pak bind\u00ebse.<\/p>\n\n\n\n<p>N\u00eb mbar\u00eb rajonin, vendet kandidate p\u00ebr an\u00ebtar\u00ebsim n\u00eb BE vazhdojn\u00eb t\u00eb p\u00ebrballen me dob\u00ebsi t\u00eb rr\u00ebnjosura institucionale, keqpraktika politike dhe korrupsion. Nj\u00eb faktor kontribues q\u00ebndron n\u00eb vet\u00eb procesin e an\u00ebtar\u00ebsimit. N\u00eb praktik\u00eb, ai shpesh ka theksuar rezultatet e zbatimit \u2013 arrestime, akuza penale dhe nd\u00ebrtimin e shpejt\u00eb t\u00eb institucioneve t\u00eb reja \u2013 n\u00eb kurriz t\u00eb garancive procedurale dhe respektimit t\u00eb procesit t\u00eb rregullt ligjor. Ky problem nuk \u00ebsht\u00eb unik p\u00ebr zgjerimin e BE-s\u00eb. \u00c7do shtet q\u00eb synon t\u00eb hyj\u00eb n\u00eb regjime nd\u00ebrkomb\u00ebtare ligjore ose ekonomike, qoft\u00eb BE, GJPN (ICC) apo OBT (WTO), p\u00ebrballet me presione t\u00eb ngjashme. Aty ku institucionet jan\u00eb t\u00eb brishta, qeverit\u00eb mund t\u2019i drejtohen p\u00ebrputhshm\u00ebris\u00eb performuese, duke i dh\u00ebn\u00eb p\u00ebrpar\u00ebsi veprimeve t\u00eb dukshme mbi reform\u00ebn e q\u00ebndrueshme.<\/p>\n\n\n\n<p>Nga k\u00ebndv\u00ebshtrimi i Brukselit dhe Uashingtonit, Ballkani Per\u00ebndimor ka p\u00ebrfaq\u00ebsuar prej koh\u00ebsh si nj\u00eb mund\u00ebsi strategjike, ashtu edhe ekonomike. An\u00ebtar\u00ebsimi n\u00eb NATO i vendeve si Mali i Zi dhe Shqip\u00ebria e p\u00ebrforcoi k\u00ebt\u00eb perceptim, duke i pozicionuar ato si pararend\u00ebse p\u00ebr an\u00ebtar\u00ebsimin eventual n\u00eb BE. Administrata t\u00eb nj\u00ebpasnj\u00ebshme amerikane, p\u00ebrfshir\u00eb ato t\u00eb president\u00ebve Obama dhe Biden, mb\u00ebshtet\u00ebn n\u00eb m\u00ebnyr\u00eb t\u00eb qet\u00eb reforma ambicioze n\u00eb sektorin e drejt\u00ebsis\u00eb n\u00eb Shqip\u00ebri, me synimin p\u00ebr t\u00eb harmonizuar institucionet vendase me standardet ligjore evropiane. K\u00ebto p\u00ebrpjekje, t\u00eb mb\u00ebshtetura nga Departamenti Amerikan i Shtetit, institucionet e BE-s\u00eb dhe organizata si Fondacioni \u201cShoq\u00ebria e Hapur\u201d, synonin forcimin e qeverisjes demokratike dhe frenimin e korrupsionit. Megjithat\u00eb, si n\u00eb shum\u00eb nisma reformuese t\u00eb drejtuara nga jasht\u00eb, kombinimi i stimujve dhe zgjedhjeve t\u00eb dizajnit institucional prodhoi pasoja q\u00eb nuk u parashikuan dhe as u adresuan plot\u00ebsisht.<\/p>\n\n\n\n<p>Reforma gjyq\u00ebsore n\u00eb t\u00eb gjith\u00eb Ballkanin \u00ebsht\u00eb p\u00ebrballur vazhdimisht me pengesa strukturore. N\u00eb disa raste, modelet e reform\u00ebs t\u00eb mb\u00ebshtetura nga aktor\u00eb t\u00eb huaj kan\u00eb favorizuar autoritet t\u00eb fort\u00eb prokurorial t\u00eb izoluar nga mbik\u00ebqyrja demokratike. N\u00eb vend q\u00eb t\u00eb forconte llogaridh\u00ebnien, ky konfigurim ka t\u00ebrhequr gjithnj\u00eb e m\u00eb shum\u00eb kritika p\u00ebr mund\u00ebsimin e drejt\u00ebsis\u00eb selektive dhe persekutimit politik. Ndjekja e besueshm\u00ebris\u00eb s\u00eb reformave jasht\u00eb vendit ka p\u00ebrkuar, n\u00eb disa raste, me nj\u00eb konsolidim t\u00eb heshtur t\u00eb pushtetit brenda vendit.<\/p>\n\n\n\n<p>P\u00ebrvojat e Malit t\u00eb Zi dhe Serbis\u00eb pasqyrojn\u00eb k\u00ebto dinamika m\u00eb t\u00eb gjera. Vler\u00ebsimet e BE-s\u00eb kan\u00eb v\u00ebn\u00eb n\u00eb dukje se Mali i Zi ka b\u00ebr\u00eb pak p\u00ebrparim n\u00eb reform\u00ebn gjyq\u00ebsore, pavar\u00ebsisht zbatimit t\u00eb nj\u00eb Strategjie p\u00ebr Reform\u00ebn n\u00eb Drejt\u00ebsi dhe planeve p\u00ebrkat\u00ebse t\u00eb veprimit. Ng\u00ebr\u00e7i politik, dialogu i dob\u00ebt institucional dhe llogaridh\u00ebnia e kufizuar e gjyq\u00ebsorit vazhdojn\u00eb, edhe pas krijimit t\u00eb institucioneve t\u00eb reja kund\u00ebr korrupsionit. N\u00eb Serbi, pezullimi i fondeve t\u00eb USAID-it n\u00eb fillim t\u00eb vitit 2025 ekspozoi se si narrativat e reform\u00ebs mund t\u00eb rip\u00ebrdoren shpejt p\u00ebr kontroll politik t\u00eb brendsh\u00ebm. Veprimet qeveritare kund\u00ebr OJQ-ve kritike ndaj transparenc\u00ebs dhe t\u00eb drejtave t\u00eb njeriut \u2013 t\u00eb justifikuara p\u00ebrmes pretendimeve p\u00ebr nd\u00ebrhyrje t\u00eb huaj \u2013 ngrit\u00ebn shqet\u00ebsime brenda BE-s\u00eb dhe theksuan brisht\u00ebsin\u00eb e angazhimeve p\u00ebr shtetin e s\u00eb drejt\u00ebs kur stimujt e jasht\u00ebm ndryshojn\u00eb.<\/p>\n\n\n\n<p>Shqip\u00ebria ofron ndoshta ilustrimin m\u00eb t\u00eb qart\u00eb t\u00eb k\u00ebtyre tensioneve. Krijimi i Struktur\u00ebs s\u00eb Posa\u00e7me kund\u00ebr Korrupsionit dhe Krimit t\u00eb Organizuar (SPAK) pas reformave kushtetuese t\u00eb vitit 2016 u promovua gjer\u00ebsisht si gur themeli i rinovimit t\u00eb drejt\u00ebsis\u00eb. Aktor\u00eb si nga SHBA-ja ashtu edhe nga BE-ja u p\u00ebrfshin\u00eb ngusht\u00eb n\u00eb form\u00ebsimin dhe mb\u00ebshtetjen e procesit, me m\u00eb shum\u00eb se 27.5 milion\u00eb dollar\u00eb amerikan\u00eb ndihm\u00eb t\u00eb drejtuara drejt sektorit t\u00eb drejt\u00ebsis\u00eb n\u00eb Shqip\u00ebri. Pritshm\u00ebria ishte q\u00eb nj\u00eb organ i fuqish\u00ebm dhe i pavarur prokurorial do t\u00eb p\u00ebrballej m\u00eb n\u00eb fund me korrupsionin e nivelit t\u00eb lart\u00eb.<\/p>\n\n\n\n<p>N\u00eb vend t\u00eb k\u00ebsaj, reformat prodhuan nj\u00eb arkitektur\u00eb gjyq\u00ebsore t\u00eb karakterizuar nga pabarazi. SPAK u shfaq si nj\u00eb institucion i fuqish\u00ebm, i drejtuar nga prokuroria, q\u00eb operon me kontrolle t\u00eb kufizuara dhe mbik\u00ebqyrje minimale demokratike. Shqet\u00ebsimet e hershme se Shqip\u00ebria po b\u00ebhej nj\u00eb terren prove p\u00ebr nj\u00eb interpretim t\u00eb zgjeruar t\u00eb pavar\u00ebsis\u00eb prokuroriale fillimisht u hodh\u00ebn posht\u00eb. Me kalimin e koh\u00ebs, megjithat\u00eb, k\u00ebto paralajm\u00ebrime fituan pesh\u00eb. Kritik\u00ebt argumentojn\u00eb gjithnj\u00eb e m\u00eb shum\u00eb se autoriteti i SPAK-ut ushtrohet n\u00eb m\u00ebnyra q\u00eb pasqyrojn\u00eb leverdi politike dhe pritshm\u00ebri t\u00eb jashtme, m\u00eb tep\u00ebr sesa drejt\u00ebsi t\u00eb paanshme.<\/p>\n\n\n\n<p>Struktura e stimujve q\u00eb rrethon reform\u00ebn kund\u00ebr korrupsionit ndihmon n\u00eb shpjegimin e k\u00ebtij rezultati. E matur ndaj standardeve t\u00eb BE-s\u00eb dhe perceptimeve nd\u00ebrkomb\u00ebtare, suksesi shpesh barazohet me veprime t\u00eb dukshme zbatimi. Arrestimet e profilit t\u00eb lart\u00eb gjenerojn\u00eb tituj dhe sinjalizojn\u00eb angazhim, edhe kur hetimet mbeten t\u00eb err\u00ebta dhe shqyrtimi gjyq\u00ebsor i kufizuar. Analist\u00eb dhe v\u00ebzhgues t\u00eb shoq\u00ebris\u00eb civile kan\u00eb ngritur shqet\u00ebsime se ndjekjet penale zbatohen n\u00eb m\u00ebnyr\u00eb t\u00eb pabarabart\u00eb, duke synuar figura politikisht t\u00eb cenueshme, nd\u00ebrsa t\u00eb tjer\u00eb kursehen.<\/p>\n\n\n\n<p>K\u00ebto shqet\u00ebsime jan\u00eb p\u00ebrforcuar nga nj\u00eb model i paraburgimit t\u00eb zgjatur para gjykimit n\u00eb disa \u00e7\u00ebshtje t\u00eb spikatura. Paraburgimi i ish-presidentit Ilir Meta nxiti akuza p\u00ebr ndjekje penale t\u00eb politizuar, nd\u00ebrsa arrestimi i kryetarit t\u00eb bashkis\u00eb me etni greke, Fredi Beleri, ngriti alarme te mbrojt\u00ebsit e t\u00eb drejtave t\u00eb pakicave. M\u00eb s\u00eb shumti, \u00e7\u00ebshtja e kryetarit t\u00eb Bashkis\u00eb s\u00eb Tiran\u00ebs, Erion Veliaj, ka ardhur t\u00eb simbolizoj\u00eb mang\u00ebsi m\u00eb t\u00eb gjera procedurale brenda sistemit t\u00eb drejt\u00ebsis\u00eb n\u00eb Shqip\u00ebri.<\/p>\n\n\n\n<p>Veliaj \u00ebsht\u00eb mbajtur n\u00eb paraburgim pa gjykim p\u00ebr gati nj\u00eb vit mbi akuza p\u00ebr korrupsion, pavar\u00ebsisht munges\u00ebs s\u00eb nj\u00eb aktakuze p\u00ebrfundimtare dhe k\u00ebrkesave t\u00eb p\u00ebrs\u00ebritura p\u00ebr masa alternative. N\u00eb n\u00ebntor 2025, Gjykata Kushtetuese e Shqip\u00ebris\u00eb vendosi se shkarkimi i tij nga detyra ishte antikushtetues, duke e rikthyer formalisht si kryetar bashkie. Megjithat\u00eb, ai ka mbetur n\u00eb paraburgim, i paaft\u00eb p\u00ebr t\u00eb ushtruar mandatin e tij. Analist\u00eb nd\u00ebrkomb\u00ebtar\u00eb t\u00eb s\u00eb drejt\u00ebs kan\u00eb paralajm\u00ebruar se paraburgimi i zgjatur i nj\u00eb zyrtari t\u00eb zgjedhur pa gjykim rrezikon t\u00eb minoj\u00eb p\u00ebrfaq\u00ebsimin demokratik dhe besimin e publikut n\u00eb pavar\u00ebsin\u00eb e gjyq\u00ebsorit.<\/p>\n\n\n\n<p>Nd\u00ebrsa faj\u00ebsia ose pafaj\u00ebsia mund t\u00eb p\u00ebrcaktohen vet\u00ebm p\u00ebrmes nj\u00eb procesi gjyq\u00ebsor t\u00eb drejt\u00eb, m\u00ebnyra e trajtimit t\u00eb \u00e7\u00ebshtjes ka p\u00ebrforcuar shqet\u00ebsimet se paraburgimi para gjykimit po p\u00ebrdoret gjithnj\u00eb e m\u00eb shum\u00eb si z\u00ebvend\u00ebsim i procesit t\u00eb rregullt ligjor. N\u00eb kontekstin e an\u00ebtar\u00ebsimit n\u00eb BE, praktika t\u00eb tilla rrezikojn\u00eb t\u00eb ngat\u00ebrrojn\u00eb zbatimin e duksh\u00ebm me reform\u00ebn e v\u00ebrtet\u00eb t\u00eb shtetit t\u00eb s\u00eb drejt\u00ebs, duke turbulluar dallimin mes llogaridh\u00ebnies dhe oportunizmit.<\/p>\n\n\n\n<p>Nj\u00eb ndryshim n\u00eb politik\u00ebn amerikane n\u00eb fillim t\u00eb vitit 2025 sh\u00ebnoi nj\u00eb pik\u00eb kthese t\u00eb m\u00ebtejshme. Vendimi i Presidentit Trump p\u00ebr t\u00eb pezulluar operacionet e USAID-it dhe p\u00ebr t\u00eb ndalur financimin e programeve t\u00eb reform\u00ebs gjyq\u00ebsore n\u00eb Shqip\u00ebri, p\u00ebrfshir\u00eb mb\u00ebshtetjen p\u00ebr SPAK-un, sinjalizoi nj\u00eb pranim t\u00eb n\u00ebnkuptuar se nismat e m\u00ebparshme ishin shnd\u00ebrruar n\u00eb mjete t\u00eb politizuara, m\u00eb shum\u00eb sesa n\u00eb instrumente t\u00eb drejt\u00ebsis\u00eb institucionale.
