Po ashtu p\u00ebr aq koh\u00eb sa kjo marr\u00ebveshje do t\u00eb jet\u00eb n\u00eb fuqi, banesa nuk mund t\u2019i shitet nj\u00eb pale t\u00eb tret\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sakaq kontrata e kalimit t\u00eb pron\u00ebsis\u00eb duhet t\u00eb shoq\u00ebrohet me deklarat\u00ebn noteriale t\u00eb heqjes dor\u00eb, nga subjektet p\u00ebrfituese, nga \u00e7do pretendim mbi t\u00eb drejtat e pron\u00ebsis\u00eb p\u00ebr banes\u00ebn apo sht\u00ebpin\u00eb individuale t\u00eb m\u00ebparshme.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00ebse qytetari q\u00eb i kalon pron\u00ebsia e sht\u00ebpis\u00eb t\u00eb re nuk plot\u00ebson t\u00eb gjitha kushtet e vendosura n\u00eb legjislacionin n\u00eb fuqi, at\u00ebher\u00eb kjo marr\u00ebveshje nuk do t\u00eb ket\u00eb fuqi ligjore dhe shteti zhvishet nga t\u00eb gjitha detyrimet e ngarkuara n\u00eb k\u00ebt\u00eb aktmarr\u00ebveshje.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">N\u00eb vendim p\u00ebrcaktohet se shteti merr p\u00ebrsip\u00ebr dhe garanton pal\u00ebn p\u00ebrfituese t\u00eb sht\u00ebpis\u00eb t\u00eb rind\u00ebrtuar se p\u00ebrgjat\u00eb gjith\u00eb koh\u00ebzgjatjes q\u00eb do t\u00eb duhet p\u00ebr dor\u00ebzimin e pasuris\u00eb, sipas parimit \u201cme \u00e7el\u00ebsa n\u00eb dor\u00eb\u201d, do t\u2019i siguroj\u00eb subvencionin e pages\u00ebs s\u00eb qiras\u00eb deri n\u00eb momentin q\u00eb k\u00ebsaj pale t\u2019i kaloj\u00eb e drejta e pron\u00ebsis\u00eb s\u00eb pasuris\u00eb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kostot e shpenzimeve noteriale dhe regjistrimi i certifikat\u00ebs t\u00eb pasuris\u00eb n\u00eb Agjencin\u00eb e Kadastr\u00ebs do t\u00eb paguhen nga shteti.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Deklarime dhe garanci t\u00eb pal\u00ebve<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">-Pala e par\u00eb, deklaron dhe garanton pal\u00ebn e dyt\u00eb p\u00ebr secil\u00ebn prej \u00e7\u00ebshtjeve t\u00eb m\u00ebposhtme:i) merr p\u00ebrsip\u00ebr q\u00eb nd\u00ebrtimin e pasuris\u00eb ta kryej\u00eb n\u00eb p\u00ebrputhje me parimet e rind\u00ebrtimit, sipas kushteve dhe teknikave q\u00eb parandalojn\u00eb rreziqet e fatkeq\u00ebsive natyrore n\u00eb t\u00eb ardhmen, bazuar n\u00eb konceptin \u201crind\u00ebrto m\u00eb mir\u00eb\u201d;ii) merr p\u00ebrsip\u00ebr t\u00eb dor\u00ebzoj\u00eb pasurin\u00eb, sipas parimit \u201cme \u00e7el\u00ebsa n\u00eb dor\u00eb\u201d, t\u00eb gatshme p\u00ebr banim; iii) do t\u00eb p\u00ebrmbush\u00eb detyrimet dhe do t\u00eb plot\u00ebsoj\u00eb kushtet e parashikuara n\u00eb k\u00ebt\u00eb marr\u00ebveshje; iv) p\u00ebr aq koh\u00eb sa kjo marr\u00ebveshje do t\u00eb jet\u00eb n\u00eb fuqi, pasuria, objekt i k\u00ebsaj marr\u00ebveshjeje, nuk mund t\u2019i premtohet, t\u2019i jepet n\u00eb p\u00ebrdorim apo t\u2019i shitet nj\u00eb pale t\u00eb tret\u00eb; v) pala e par\u00eb deklaron dhe siguron se ka autoritetin dhe miratimet e duhura p\u00ebr t\u00eb n\u00ebnshkruar, zbatuar dhe p\u00ebrmbushur dispozitat e k\u00ebsaj marr\u00ebveshjeje; vi) pala e par\u00eb merr p\u00ebrsip\u00ebr dhe garanton pal\u00ebn e dyt\u00eb se, p\u00ebrgjat\u00eb gjith\u00eb koh\u00ebzgjatjes q\u00eb do t\u00eb duhet p\u00ebr dor\u00ebzimin e pasuris\u00eb, sipas parimit \u201cme \u00e7el\u00ebsa n\u00eb dor\u00eb\u201d, do t\u2019i siguroj\u00eb subvencionin e pages\u00ebs s\u00eb qiras\u00eb deri n\u00eb momentin q\u00eb k\u00ebsaj pale t\u2019i kaloj\u00eb e drejta e pron\u00ebsis\u00eb s\u00eb pasuris\u00eb, n\u00eb baz\u00eb t\u00eb vlerave dhe kushteve t\u00eb miratuara, n\u00eb p\u00ebrputhje me aktet ligjore dhe n\u00ebnligjore n\u00eb fuqi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">-Pala e dyt\u00eb deklaron dhe garanton pal\u00ebn e par\u00eb p\u00ebr secil\u00ebn prej \u00e7\u00ebshtjeve t\u00eb m\u00ebposhtme: i) pala e dyt\u00eb pranon kushtet n\u00eb k\u00ebt\u00eb marr\u00ebveshje dhe \u00ebsht\u00eb plot\u00ebsisht dakord q\u00eb, n\u00eb momentin e duhur dhe pas plot\u00ebsimit t\u00eb kushteve t\u00eb vendosura sipas legjislacionit n\u00eb fuqi, t\u00eb n\u00ebnshkruaj\u00eb kontrat\u00ebn p\u00ebrfundimtare t\u00eb kalimit t\u00eb pron\u00ebsis\u00eb s\u00eb pasuris\u00eb, objekt i k\u00ebsaj marr\u00ebveshjeje; ii) kjo marr\u00ebveshje p\u00ebrb\u00ebn nj\u00eb detyrim ligjor, t\u00eb vlefsh\u00ebm dhe t\u00eb ekzekutuesh\u00ebm p\u00ebr pal\u00ebn e dyt\u00eb, e cila i ka t\u00eb gjitha kompetencat t\u00eb lidh\u00eb k\u00ebt\u00eb marr\u00ebveshje dhe t\u00eb p\u00ebrmbush\u00eb detyrimet q\u00eb rrjedhin prej saj;
